Risks of mass deportation: new legal realities for asylum seekers from the North Caucasus
Russia has designated the structures of the ChRI as a terrorist organization. This decision establishes a legal foundation for rapid extradition. Asylum seekers in Western countries are under threat. Particular emphasis is placed on 14 European states.
This act is a legal absurdity. The international community officially recognizes Russia as a state sponsor of terrorism. Despite this, it attempts to unilaterally declare a government in exile as terrorists. This applies to all affiliated and non-affiliated structures alike — everyone who opposes Russia.
There are loyal politicians in Western countries. They will covertly lobby for the interests and requests of the Russian Federation. The risk of such actions is extremely high. Consequently, asylum seekers are in grave danger. This affects individuals not only from Chechnya. The entire North Caucasus has fallen into the high-risk zone for mass deportations.
It is possible to counter these threats. Our legal practice confirms this. An illustrative example is the public case of Ali Bataev. The Swiss migration authorities had planned his deportation to Russia. The case received widespread media coverage.
Our fruitful work yielded results. We managed to save Ali Bataev from extradition. There are hundreds of similar successful cases in our practice. We cannot share their details due to strict confidentiality. Therefore, we refer to this public precedent.
Thanks to our productive work, Amnesty International released a briefing on January 17, 2024, urging countries: “Europe must stop returning natives of the North Caucasus to Russia, where they face torture and ill-treatment.” Thanks to this briefing, many have obtained political asylum in European countries.
